Ancillary Probate

If you are the executor or the administrator of an estate that has real estate (or a business) located in state besides the one in which the decedent was domiciled, there is a good chance that you will have to deal with an ancillary probate. This means you may have to conduct an additional probate action in each state that the decedent owns such assets. For the most part, the process is usually not that complex, but the rules of each state must be followed when doing an ancillary probate, including payment of estate and inheritance taxes.
